North Custom Packaging retains ownership of all literature, materials, and manufacturing know-how used in producing custom boxes and packaging. We do not sell or share our proprietary materials or production content with third parties. Unless otherwise agreed in writing, North Custom Packaging may also distribute free samples and display completed packaging for portfolio or website purposes.

Account Registration and Security

Authorization to Manufacture

By placing an order, you confirm that you are legally authorized to do so and that you authorize North Custom Packaging to manufacture products on your behalf based on the approved specifications and proofs. You also confirm that you are of legal age to enter into a binding agreement.

Rules of Liability and Indemnification

By using this website or placing an order with North Custom Packaging, you agree to indemnify and hold harmless North Custom Packaging, including its representatives, directors, employees, affiliates, subcontractors, suppliers, vendors, and partners, from claims arising from:

• Infringement of any patent, copyright, or intellectual property rights.
• Scandalous, obscene, defamatory, libelous, or slanderous content submitted by you.
• Unauthorized access to password-protected areas.

You agree to cover any related damages, losses, expenses, and legal costs.

North Custom Packaging is not responsible for death, injury, loss, damage, delay, accidents, acts of God, or any special, punitive, consequential, or incidental damages, whether arising in contract or tort.

To the maximum extent permitted by law, North Custom Packaging’s total liability for any claim will not exceed the amount paid by the customer for the applicable order.

Reprints, Quality Claims, and Refund Policy

Since all packaging is custom made, our process differs from traditional retail returns. Eligible quality concerns are handled through a reprint process.

Reporting Timeframe

If you believe the delivered products are defective or were not produced according to the approved specifications due to our error, you must notify us within 7 calendar days of delivery. Supporting evidence, such as photos or video, is required.

Quality Control Review

Our Quality Control team reviews each claim to determine whether the issue resulted from a production error or from customer-provided information, approved proofs, or product misuse.

Resolution

• If the issue is confirmed as our responsibility, we will reprint the affected quantity at no cost.
• If the issue is due to customer-provided files, incorrect specifications, or proof-approved errors, reprint costs will be the customer’s responsibility.
• Refunds are generally not issued once production has started. Any exception is at management’s discretion and applies only if production has not begun.

Order Placement, Pricing, Payments, and Cancellations

Pricing and Currency

All prices are listed in USD unless otherwise stated.

Payment Requirement

Due to the custom nature of our products, production does not begin until payment terms are met and the digital proof is approved.

Payment Methods and Fees

Payment options may include credit and debit card payments, bank or wire transfers, and other invoice-based methods approved by North Custom Packaging.

• Wire and bank transfers are free from North Custom Packaging.
• Online card payments may include a processing fee, as communicated on the invoice or payment link.
• Bank account details are provided on the invoice for customers who prefer to pay via bank transfer.

Net Terms and Installments

Net 30, Net 60, installment plans, or other flexible payment terms may be offered only to approved partners. These arrangements require a signed Partnership MOU or Agreement and appropriate company verification.

Proof Approval and Production Start

As part of the order process, customers must approve the electronic proof. Once the proof is approved, the order typically moves into production quickly, often within hours, and changes are generally not possible.

Cancellations

• If production has not started, cancellation may be considered within a limited period after proof approval. If approved, a cancellation fee may apply, as outlined by your account manager or in the invoice terms.
• Once production begins, cancellations are not permitted due to the custom manufacturing process.

Note: This section is intended to reflect the intent of existing cancellation terms while aligning with actual production timelines.

Design Orders

North Custom Packaging does not offer refunds or credits for design services. All design service orders are non-refundable.

Sales Tax Policy

Sales tax may apply to orders. Customers claiming tax exemption must provide a valid tax exemption certificate at the time of order placement.

Terms of Artwork and File Submission

We may create electronic proofs and, where applicable, hard-copy proofs using files provided by the customer. For best results, customers should submit artwork at 300 DPI and in CMYK format whenever possible.

• If artwork is not print-ready, below 300 DPI, or submitted in an incorrect format, North Custom Packaging is not responsible for issues such as blurriness, pixelation, distortion, or color changes caused by file conversion.
• Customers are responsible for ensuring artwork accuracy, alignment, and orientation. While we take reasonable steps to protect submitted files, we are not responsible for the loss or damage of artwork files.
• By uploading artwork, you confirm that you own the content or have written permission to use it.
• North Custom Packaging reserves the right to refuse any order that is unlawful, infringes third-party rights, or contains offensive or inappropriate content.

Proofs and Color Accuracy

Customers must approve all proofs before production begins. Delays in proof approval may affect delivery timelines. Turnaround times start after proof approval, in line with standard packaging production processes.

Customers must review proofs carefully for:

• Copy, spacing, fonts, and punctuation.
• Image placement and layout.
• Bleeds and safety margins.

Digital proofs may not accurately reflect transparency, RGB-to-CMYK conversions, Pantone-to-CMYK conversions, or all print effects. Finishes such as UV coating or lamination can also affect final color appearance.

While we aim to reproduce colors as accurately as possible, exact color matching cannot be guaranteed due to printing limitations and material variations. Minor color differences may occur, and reprints for minor color variation are not guaranteed.

Customers are responsible for the final approved proof.

Gang Printing

North Custom Packaging generally does not use gang printing for most products. In some cases, we may select the printing method that best fits the product and production requirements.

Overruns and Underruns

We aim to deliver the exact quantity ordered and may include extra units at no additional charge. Standard trade practice allows for a quantity variation of up to 5%.

If fewer units are delivered due to an underrun, billing may reflect the actual quantity delivered, subject to confirmation by our Quality Control team.

Delivery, Shipping, and Timelines

Delivery timelines vary based on product type, order quantity, and destination. North Custom Packaging offers multiple end-to-end delivery options, and your account manager will confirm the estimated schedule at the time of order placement.

North Custom Packaging is not responsible for delays caused by customs clearance, carrier issues, weather conditions, or events beyond our reasonable control.

Governing Law and Jurisdiction

These Terms & Conditions, and any invoices, payment terms, credit arrangements, or disputes related to orders, are governed by the laws of the State of Illinois, United States.

Any dispute, claim, or legal proceeding arising from or related to these Terms & Conditions, invoices, payment obligations, chargebacks, or orders shall be filed and resolved under the jurisdiction of the courts located in Illinois.

Changes to Website and Terms

North Custom Packaging may change any part of the website or these Terms & Conditions at any time. Changes take effect immediately upon posting. Continued use of the website indicates acceptance of the updated terms.
